How to request a record
- Complete Form C (the prescribed request form under the PAIA Regulations), available from inforegulator.org.za.
- Send it to the Information Officer at the address above.
- Provide enough detail for us to identify the record, and give the form of access you want.
- If you are requesting the record to exercise or protect a right, say which right and how the record would help.
- Pay the prescribed request fee where one applies.
We will decide within 30 days and notify you in writing. That period may be extended by up to a further 30 days in the circumstances PAIA allows. If we refuse, we will give reasons and explain how to appeal.
Fees
PAIA prescribes two fees: a request fee payable on submission, and an access fee covering the cost of searching for, preparing and copying the record. Current amounts are set out in the PAIA Regulations and available from the Information Regulator. We will quote you before proceeding, and you may appeal the amount.
Grounds for refusal
PAIA obliges or permits us to refuse access in certain cases, including where disclosure would:
- Unreasonably disclose personal information about a third party
- Harm the commercial or financial interests of a third party, or our own
- Breach a duty of confidence owed to a third party
- Prejudice legal proceedings, or disclose privileged material
- Reveal research information that could prejudice the researcher
Processing of personal information
The categories of personal information we process, the purposes, the recipients, any cross-border transfers and our security measures are described in full in our privacy notice, which forms part of this manual.
If we refuse
You may lodge a complaint with the Information Regulator, or apply to a court, within 180 days of being notified of our decision.
